Panama Supreme Court Rules law 406 Unconstitutional


November 28th 2023, La Prensa reported that Panama’s Supreme Court of Justice (CSJ) declared, unanimously, that Law 406 of October 20, 2023, is unconstitutional. 





The law approves the mining concession contract between the State and Minera Panamá (the local subsidiary of Canadian mining company First Quantum Minerals) 

After carrying out an “integrated review” of said law, the magistrates indicated that the regulations violate 25 articles of the Constitution of the Republic of Panama.

“ For the Plenary of the Supreme Court of Justice, there is no doubt that we are in the presence of a constitutional conflict of a specific type, in which in this case the fundamental rights of the Panamanian population are confronted, such as the right to "life, health and a healthy environment free of pollution, which come into collision with the particular interest arising from private investments that seek economic growth ."
